If your exclusivity agreement is terminated, you may still sell your products on other marketplaces or through your own website.
Do all of my items need to be exclusive?
At the Momensity Marketplace, exclusivity is opt-in and applies at the account level. This means that if you choose to be an Exclusive author, it only applies to the items (and related items) you sell via that account. You can still create and sell items outside of the Momensity Marketplace, as long as those items are not related to the ones you are selling exclusively on our platform.
If you want to make some of your items available on an exclusive basis, and others available on a non-exclusive basis, you can create two separate accounts – one for exclusive items and one for non-exclusive items.
You can change the exclusivity status of your account at any time through your Account Settings. However, if you choose to opt out of exclusivity and switch to a non-exclusive account, you will need to wait for 30 days before the change takes effect. After the 30-day period, you will be free to offer the items in that account outside of the Momensity Marketplace, and the author fee you pay to us will change to the non-exclusive rate. If you choose to opt into exclusivity, the change will take effect immediately.

What about my own projects or freelance work?
At the Momensity Marketplace, we understand that as a vendor, you may have other personal projects or freelance work that may require the use of your own exclusive items. You are permitted to use your own exclusive items in connection with your personal projects or general freelance activities, as long as they are not directly related to the item or part of a publicly available service that would breach our Exclusivity Policy.
For example, you can use your own exclusive Momensity Prompt App to create automated creation services for a client or personal project. You can also use your own exclusive WordPress Momensity Prompt App to create a customized website for a client project.
However, you are not allowed to buy your own items on the Momensity Marketplace, whether they are exclusive or not, as this is against our Author Terms as a precaution against fraudulent or disreputable conduct.
Regarding third-party involvement, if you choose to make your items available on an exclusive basis, you are not permitted to have any involvement with any person or business that offers any products or services that, if offered by you, would breach our Exclusivity Policy. This means that you cannot authorize another person or business to create and sell products or services that are related to your exclusive items outside of the Momensity Marketplace.
For example, if you are an author of a theme sold exclusively on our platform, you should not authorize an external developer to create an add-on for that theme and sell it outside of the Momensity Marketplace. Similarly, if you are an author of an exclusive music track, you should not authorize another artist to create a remix of that track and sell it outside of our platform.

What happens if I breach exclusivity?
At the Momensity Marketplace, we take our Exclusivity Policy very seriously. If you breach exclusivity by selling, distributing, or giving away your exclusive products or any related items outside of our platform, we may take action to address the breach.
The specific action we take will depend on the nature and extent of the breach. In most cases, we may require you to change the status of your account to non-exclusive or make the change on your behalf. This means that the author fee you pay for using our platform and services will increase to the non-exclusive rate, as specified in our Author Fee Schedule. We may also increase the author fee you pay during the interim period from the time we become aware of the breach until the account status change is effective.
In more serious cases, we may disable your account entirely.
If we determine that your items are within the same Product Family, we are likely to require you to change the status of your account to non-exclusive.
